These terms govern use of iTach BizPOS ("the Service") provided by iTach Technologies. By creating an account you agree to them on behalf of your business.

1. Subscription

The Service is offered on monthly or yearly plans after an optional free trial. Fees, limits and included features are shown on the Pricing page. Optional services such as setup, data migration, training, hardware configuration, custom development, M-Pesa Daraja and eTIMS integration are charged separately as quoted.

2. Payment & suspension

Subscriptions are paid in advance. If payment is not received by the renewal date, a grace period applies, after which access is limited until payment is made. Your data is retained and can be exported; it is not deleted because of late payment.

3. Your responsibilities

Keep login details confidential and assign appropriate permissions to staff.
Ensure that the information you record is accurate and lawfully collected, including customers' personal data.
Comply with tax obligations. Reports produced by the Service are management information, not tax or legal advice.

4. M-Pesa & tax integrations

SMS-based payment capture relies on confirmation messages received on your own phone. Automated M-Pesa (Daraja) and eTIMS functions are activated only after the relevant provider approvals; the Service does not claim to be eTIMS certified unless expressly stated.

5. Availability & support

We aim for high availability and provide support during published hours. Planned maintenance will be communicated where practical.

6. Data & privacy

Our Privacy Policy forms part of these terms. You own your business data.

7. Liability

To the extent permitted by law, our liability is limited to the subscription fees paid in the three months before the claim.

8. Termination

You may cancel at any time. We may suspend accounts that breach these terms or the law.

9. Governing law

These terms are governed by the laws of Kenya.
